  • The Architecture of Adaptation: Why Educational AI Policy Must Begin with Human Understanding

    Abstract

    As generative artificial intelligence rapidly enters educational environments, institutions have responded with policies that often struggle to keep pace with technological change. This paper argues that the challenge of educational AI governance lies not in the absence of policy, but in the limitations of traditional, compliance-driven approaches. Drawing on administrative experience, it proposes a shift from rigid mandates toward mindset-based policy grounded in shared principles and human understanding. The paper introduces three pillars—intellectual humility, distributive wisdom, and ethical imagination—as a framework for adaptive governance in AI-enabled learning contexts. It concludes that institutions best prepared for ongoing technological disruption will be those that prioritize judgment, trust, and adaptability over exhaustive rulemaking.

    The Paradox of Permanence

    When reflecting on my decades long administrative tenure in higher education, it is easy enough to recollect the hundreds of policy initiatives I saw come and go. Most were introduced with great fanfare and optimism, accompanied by bold promises of transformation, only to be quietly whisked under the proverbial rug of the failed initiative du jour. Seldom were they around long enough to withstand the effects of time or to produce any real sense of consistency or stability.

    Every one of them promised transformation and hope.
    Most simply delivered frustration and contempt.

    In my experience, successful policies did not begin by changing what people did–they changed how people thought and felt. That insight has taken on new urgency now that artificial intelligence has arrived in our educational ecosystems.

    Why AI Policy Feels So Elusive

    In the midst of growing uncertainty about how educational institutions should respond to generative artificial intelligence, I was introduced to a phrase that helped clarify what so many administrators and educators were struggling to articulate. During a conversation with Dr. James Robinson of Jackson State University, he described the challenge succinctly as a need for “mindsets over mandates.” The phrase immediately resonated with me because it captured a fundamental shift in how AI policy must be understood.

    Within this Feature, when I use the phrase mindsets over mandates I do not mean the absence of policy. Rather, I refer to a shift in emphasis—from rigid, compliance-driven rulemaking toward shared principles that guide judgment in environments defined by rapid change and uncertainty. Such an approach prioritizes understanding why and how decisions are made, rather than relying solely on exhaustive lists of rules that quickly become obsolete.

    This distinction matters because AI technology has amplified our economies, our voices, and our access to information in new ways few could have predicted even a decade ago. In education, it has also produced a compound challenge: the emergence of what we broadly—and often vaguely—refer to as AI policy.

    In just a few years, AI policy has morphed from a trendy buzzword into an intellectually ambiguous concept. Since the public release of ChatGPT, administrators, faculty, and students alike have found themselves asking the same question: what are the rules of engagement supposed to look like now? We think we understand the issue; yet, the honest truth is that many institutions are more confused than ever.

    This confusion is not a failure of leadership. Rather, it is the result of a structural mismatch between how educational policy has traditionally been crafted and the pace at which AI technologies evolve. Understanding AI policy through the lens of mindsets over mandates helps explain why traditional approaches feel insufficient—and why a different framework is now required.

    The New Economy of Learning

    Much like economists study consumer behavior to predict market shifts, educational leaders are now being forced to reimagine student learning habits in an AI-enabled world. Students today have access to generative tools that can draft essays, solve problems, write code, generate images, and increasingly operate with a degree of autonomy. These tools are reshaping cognition, study behavior, and classroom dynamics in real time.

    Administrators and faculty now find themselves managing a process that was never intended to be managed—one that assumes linearity, predictability, and reproducibility in an environment that no longer responds to those assumptions.

    Technology has forced our hand. The question is no longer whether institutions will respond, but how.

    Will we repeat history’s mistakes by rushing toward rigid regulatory frameworks, or can we embrace a fundamentally different approach—one that prioritizes cognitive flexibility over compliance checkboxes?

    The Velocity Problem

    To understand why traditional approaches struggle, consider the actual lifespan of an educational policy. In my experience, a policy takes eighteen months to develop, six months to approve, and another year to implement. By that timeline, any AI policy written in 2025 will not be fully operational until 2027.

    Meanwhile, the technologies it attempts to regulate will evolve through several iterations.

    I call this the velocity problem—the fatal mismatch between the speed of technological change and the pace of institutional adaptation. Traditional policymaking presumes a stable target. But policy development in education has been constrained by governance cycles, accreditation requirements, legal review, and shared governance structures. It could not realistically move at the same pace as software development.

    When your target moves faster than your ability to aim, the answer is not to shoot faster. It is to stop aiming at fixed points altogether.

    Reimagining Policy as Philosophy

    During my tenure as a dean at a rural community college serving predominantly first-generation students with limited resources, I learned something profound: the most effective policies were rarely the most detailed ones. They articulated clear principles while allowing room for local interpretation and professional judgment.

    Local over systemic.
    Nimble over arduous.
    Flexible over rigid.

    And yet, even as I write this, I can still hear a familiar voice insisting, “This is not how policy is supposed to work.” We have been conditioned to believe that good policy must be laborious, semi-permanent, and exhaustive—designed to cover every conceivable contingency with headings, subheadings, and footnotes.

    The result is often a policy that feels complete enough to be placed in a binder on an administrator’s bookshelf, where it quietly collects dust and rarely sees the light of day.

    AI exposes the limits of that approach. These technologies demand that we treat policy less like a fixed rulebook and more like an adaptive philosophy of common sense—one grounded in an honest understanding of how students actually learn in digitally saturated environments.

    The Three Pillars of a Mindset-Based Approach

    Through my work with institutions across the country, one thing has become clear: while AI-related challenges are often treated as local problems, they are far more universal than most institutions assume. Yet despite widespread experimentation, substantive answers remain elusive.

    What follows are three foundational pillars that consistently emerge when institutions move beyond compliance-driven policy and toward meaningful adaptation.

    Pillar One: Intellectual Humility

    The pace at which AI technology is advancing far surpasses our sociological and cultural ability to fully process it ethically, safely, or responsibly. Intellectual humility begins at the uncomfortable point where knowledge ends and speculation begins.

    Unlike previous educational technologies, the trajectory of AI remains fundamentally unpredictable. The large language models institutions rushed to regulate just two years ago are already giving way to agentic systems that operate with increasing independence.

    For this reason, intellectual humility demands policies that openly acknowledge uncertainty—policies with explicit expiration dates, mandatory review cycles, and a clear understanding that current knowledge is provisional at best.

    This represents a fundamental departure from traditional governance, where authority has historically derived from mastery and certainty. In an AI context, effective leadership requires the courage to say “I don’t know” without losing credibility.

    Pillar Two: Distributive Wisdom

    Best practices, particularly in moments of technological disruption, remain a philosophical pursuit at best. What works well in theory often proves far more complicated in practice.

    For decades, educational policy has largely flowed from the top down. In an AI-enabled environment, that model belongs to a bygone era. Adjuncts and professors actively experimenting with AI in their classrooms often understand its pedagogical implications more clearly than senior administrators. Students using these tools late into the night see possibilities—both creative and problematic—that many institutions have yet to formally or informally acknowledge.

    Distributive wisdom means creating channels for insight to flow upward and sideways, not just downward. In practice, this might include faculty-led AI working groups that inform policy review, or structured mechanisms for incorporating student experiences into governance conversations.

    When institutions fail to honor distributive wisdom, they produce policies that feel disconnected from lived reality—and are therefore quietly and easily ignored by students and faculty alike.

    Pillar Three: Ethical Imagination

    Too often, educational technology policy focuses exclusively on return on investment, institutional discomfort, and risk mitigation to prevent issues such as  lawsuits. While these concerns are real, a purely defensive posture blinds institutions to transformative possibilities.

    Ethical imagination asks a broader set of questions: How might this technology expand access to education? What forms of learning could it enable that never existed before? What do we lose when fear becomes our primary governance strategy?

    Policies that only seek to prevent harm may protect institutions, but they rarely inspire innovation.

    The Implementation Paradox

    Here is an uncomfortable truth: the institutions most eager to implement AI policies are often the least prepared to use AI effectively. In such cases, policy functions as an institutional security blanket—a substitute for genuine understanding.

    This creates what I call the implementation paradox: the more detailed your policy, the less likely it is to be meaningfully implemented.

    Genuine implementation requires comprehension, not compliance. When educators understand the “why” behind AI governance, they make better decisions than any policy can dictate. What replaces exhaustive mandates is not the absence of governance, but governance grounded in shared understanding rather than rigid rulemaking.

    The Courage to Trust

    Adopting a mindset-over-mandate approach requires a new form of institutional courage. It means trusting educators to make professional judgments. It means accepting that some will make mistakes. And it means believing that transparency and dialogue can accomplish what regulation alone cannot.

    This is not naïve optimism. It is pragmatic recognition that in an era of exponential change, adaptability will always outperform accuracy.

    The Path Forward

    For institutions, the starting point is not another policy draft, but a series of questions.

    Convene stakeholders not to legislate, but to explore. What opportunities does AI present? What concerns keep us awake at night? What values must we preserve? Institutional mission statements should serve as both a beginning and North Star.

    Create learning laboratories—physical or virtual spaces where educators, administrators, and even students can experiment with AI tools without fear of reprisal. Document discoveries. Share insights. Build collective wisdom.

    Develop governance from foundational principles upward. Start with values, articulate guiding principles, and only then offer flexible guidelines—never exhaustive lists.

    Finally, measure understanding, not compliance. Track AI literacy, educator confidence, and innovative practices. These indicators predict institutional success far better than violation statistics.

    Conclusion: From Mandates to Mindsets

    As hundreds—perhaps thousands—of institutions draft AI policies this academic year, many will find those policies obsolete before full implementation. This is not cynicism. It is a mathematical certainty given the pace of technological change.

    But institutions that prioritize mindsets over mandates can build something far more durable: cultures of thoughtful judgment, adaptive learning, and shared responsibility. An AI policy, in this sense, is not merely a document. It is a symbolic representation of how an institution understands its technological ecosystem and its educational mission.

    This perspective may feel avant-garde by today’s standards. But education is too complex, AI too dynamic, and our collective future too important for any single voice or mindset to claim definitive answers.

    The future of education will not be determined by who writes the most comprehensive AI policies. It will be shaped by those who build the most adaptive, reflexive, and humane educational cultures.

  • Principles of AI Policy: An Interview with Rebekah Staples, President of Free State Strategies

    In September 2025, James Robinson of Jackson State University sat down with Rebekah Staples, President and Founder of Free State Strategies, to discuss what effective public policy requires, and why ethical guardrails, public trust, and clear communication are essential as AI becomes more embedded in education.

    With more than a decade of experience in Mississippi public policy and communications, Staples has worked inside state government and alongside decision-makers shaping legislative priorities, including as Policy Director in the Office of Lieutenant Governor Tate Reeves (2012). Her work across budgeting, workforce development, government efficiency, and legislative strategy informs her perspective on how states can adopt AI responsibly and transparently.

    James Robinson (JR): Rebekah, thank you for joining me. I want to start with the basics. What makes good public policy?

    Rebekah Staples (RS): That’s a tough one. I think there are a few key steps that lead to effective policy. First, figure out your goal; what are you trying to change or improve? It sounds simple, but a lot of policies start without that clarity. Maybe your goal is to improve reading scores, or to rewrite a funding formula focused on student needs rather than staffing units. You need that endpoint before you start.

    Then do your research. Look at models from other states or districts. You don’t have to reinvent the wheel, but you should understand what already works. And make sure it can be localized, as a one-size-fits-all approach rarely works, especially in a rural state like Mississippi.

    Finally, communicate. The squeaky wheel gets the grease, and it’s no different in public policy. Collaboration is key. Good policy doesn’t come from shoving ideas down people’s throats, but rather it comes from listening and building relationships.

    JR: Many Mississippians get nervous about approaching superintendents or legislators. How can they overcome that fear?

    RS: I understand that completely and I still get nervous sometimes myself. Fear comes from the unknown. If you’re anxious about meeting with an official, start by learning about them. Read their social media, see what issues matter to them, and find common ground.

    We forget that policymakers are people too. Maybe they just posted a photo from a Little League game and you can connect on that. Then link it to your issue: “As a coach or parent, have you thought about how AI could encourage teamwork among kids?”

    And remember, you have every right to speak up. You’re a taxpayer, a citizen, and the government works for you. Be polite, be informed, and don’t be afraid to reach out. The biggest changes often come from local voices speaking directly to their representatives.

    JR: Once you’ve done the research and you’re ready to write, where do you start?

    RS: I start by understanding the landscape of what’s already out there. I look at academic research, industry trends, laws, and what private and public sectors are doing. I talk to people. Policymaking isn’t done in isolation.

    Then I write in a way that reflects both my goals and what stakeholders have shared. The best policies create a win-win, so something practical that works for many, not just a few. And I always aim to write policies that can be replicated. A small pilot that works locally can grow statewide.

    JR: Where does the language of policy come from?

    RS: It rarely comes from one place. Sometimes I’ve written laws from scratch which are clean, simple, and clear to avoid unintended consequences. Other times, I adapt existing laws. For example, a new AI law might expand a current technology statute.

    There are national resources like the National Conference of State Legislatures (NCSL). You can see what other states have done, then localize it. And of course, attorneys are part of the process because they make sure your wording aligns with existing laws. You don’t want a great idea derailed by a legal technicality.

    JR: How do you make policy adaptable for the future?

    RS: Don’t be too specific. Build frameworks, not formulas. Leave room for local decision-making. I believe the government closest to the people knows best. I like policies that encourage local experimentation.

    For example, say the state creates an AI innovation fund. Districts could apply for grants to test tools in classrooms. If one model works, the state can scale it. That’s adaptability in action policy that learns from practice.

    JR: Let’s talk ethics. What principles should guide AI policy?

    RS: First, do no harm. That’s from medicine, but it applies here. Start with privacy and protect student data and follow federal laws like FERPA.

    Second, transparency. People are more likely to trust what they understand. Tell the public what you’re doing and why.

    Third, use AI to enhance, not replace. It should strengthen teaching and learning, not replace human thinking or judgment. And always define what success looks like. If your policy doesn’t deliver measurable benefits, revisit it.

    JR: How do you write those ethics into policy?

    RS: You can include them in legislative findings: “The Legislature finds that artificial intelligence can improve education but must be implemented transparently and ethically.”

    Or build them into district-level procedures, so things like annual town halls or required data privacy reviews. I’d even love to see an AI Bill of Rights. It would set clear guardrails for safety, privacy, and accountability.

    JR: You mentioned Mississippi’s approach. What examples stand out?

    RS: The Governor’s [Tate Reeves] Executive Order on Artificial Intelligence is a great example. It directs our state’s IT agency to identify how AI is being used across departments, where it isn’t, and what laws apply. It also establishes definitions and a timeline for reporting.

    That’s a good model for districts: start by defining terms, collecting data, and engaging stakeholders. It’s not overly complicated and it’s a framework that lets you adapt as technology evolves.

    JR: How should districts measure whether their AI projects are successful?

    RS: Start with a baseline. You can’t measure progress without knowing where you began. Gather both quantitative and qualitative data such as graduation rates, teacher feedback, and parent surveys.

    Keep it simple and consistent. Check in periodically, not just at the end. And when you report results, be concise. Policymakers want to know: Did it work? Yes or no. A one-page summary often communicates more than a thirty-page report.

    JR: What advice would you give educators who want to influence policy?

    RS: Communicate, do your homework, and don’t be afraid to ask questions. People miss opportunities because they don’t want to look uninformed. Be the squeaky wheel and persist.

    Do your research, stay focused on your goals, and connect ideas to outcomes. Policymakers listen when you bring solutions, not just problems.

    JR: And finally, in one sentence, what’s your call to action for those shaping AI’s future in education?

    RS: Focus on improving educational outcomes and experiences for students and teachers, but do it without sacrificing public trust, data privacy, or human critical thinking.

    AI should make learning more equitable and dynamic, not less human.
